Terms & Conditions

Please read these terms and conditions carefully before using our services.

1. Definitions

1.1 "Supplier" shall mean Total Cleaning Solutions (TCS), its successors and assigns or any person acting on behalf of and with the authority of TCS.

1.2 "Client" shall mean the Client (or any person acting on behalf of and with the authority of the Client) as described on any quotation, work authorisation or other form as provided by TCS to the Client.

1.3 "Services" shall mean all cleaning services supplied by TCS to the Client and includes any advice or recommendations.

1.4 "Price" shall mean the price payable for the Services as agreed between TCS and the Client.

1.5 "Premises" shall mean the Client's property where Services are to be performed.

2. Acceptance

2.1 Any instructions received by TCS from the Client for the supply of Services and/or the Client's acceptance of Services supplied by TCS shall constitute acceptance of the terms and conditions contained herein.

2.2 Where more than one Client has entered into this agreement, the Clients shall be jointly and severally liable for all payments of the Price.

2.3 Upon acceptance of these terms and conditions by the Client, the terms and conditions are binding and can only be amended with the written consent of TCS.

2.4 The Client undertakes to give TCS at least fourteen (14) days notice of any change in the Client's name, address and/or any other change in the Client's details.

3. Service Description

TCS provides professional cleaning services including but not limited to:

  • Residential cleaning services
  • Commercial cleaning services
  • Office cleaning and facilities management
  • Carpet cleaning and steam cleaning
  • Pressure cleaning and window cleaning
  • Deep cleaning and spring cleaning
  • End of lease and vacate cleaning
  • Post-construction cleaning

All services are provided in Brisbane and Gold Coast areas as specified in our service agreement.

4. Booking and Scheduling

4.1 Booking Process: All bookings must be confirmed through email at info@tcsaustralia.com.au or through our online contact form.

4.2 Scheduling: We will provide a confirmed appointment time within 24 hours of your booking request.

4.3 Cancellation: Cancellations must be made at least 24 hours in advance. Late cancellations may incur a fee.

4.4 Access: Client must provide safe and reasonable access to the Premises during scheduled service times.

5. Price and Payment

5.1 At TCS's sole discretion the Price shall be either:
(a) as indicated on invoices provided by TCS to the Client in respect of Services supplied; or
(b) TCS's quoted Price which shall be binding upon TCS provided that the Client shall accept TCS's quotation in writing within seven (7) days.

5.2 TCS reserves the right to change the Price in the event of a variation to TCS's quotation or changes in scope of work.

5.3 At TCS's sole discretion a deposit may be required before commencement of Services.

5.4 At TCS's sole discretion:
(a) payment shall be due on completion of the Services; or
(b) payment shall be due before commencement of the Services; or
(c) payment for approved Clients shall be made in accordance with TCS's payment schedule.

5.5 Time for payment for the Services shall be of the essence and will be stated on the invoice. If no time is stated then payment shall be due seven (7) days following the date of the invoice.

5.6 Payment will be made by cash, credit card, bank transfer, or by any other method as agreed between the Client and TCS.

5.7 GST and other taxes and duties that may be applicable shall be added to the Price except when expressly included in the Price.

6. Client Responsibilities

6.1 Preparation: Clients should remove valuable and fragile items from cleaning areas before service begins.

6.2 Safety: Clients must inform TCS of any potential hazards or special requirements before service begins.

6.3 Keys and Security: Any keys or access codes provided to TCS are confidential and must be maintained with strict security.

6.4 Utilities: Client must ensure adequate power, water and lighting are available for the performance of Services.

7. Liability and Insurance

7.1 Insurance: TCS maintains comprehensive public liability insurance for all services provided.

7.2 Liability Limits: Our liability is limited to the cost of re-performing the service or refunding the service fee.

7.3 Damage Claims: Any damage claims must be reported within 24 hours of service completion.

8. Service Guarantee

8.1 Quality Guarantee: We guarantee the quality of our work. If you are not satisfied, we will return to address any issues at no additional cost.

8.2 Guarantee Period: Our service guarantee is valid for 48 hours after service completion.

9. Privacy and Confidentiality

TCS respects your privacy and maintains strict confidentiality regarding your premises and personal information. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal data.

10. Termination

Either party may terminate ongoing service agreements with 7 days written notice. All outstanding payments must be settled before termination takes effect.

10. Contract Auto-Renewal

10.1 For ongoing commercial cleaning contracts, we require 3 months written notification of cancellation, prior to the expiry of your contract, or your contract automatically renews for a further 12-month period.

10.2 Residential cleaning services may be cancelled with 14 days written notice unless otherwise specified in the service agreement.

11. Limitations and Restrictions

11.1 TCS shall be under no liability whatever to the Client for any indirect loss and/or expense (including loss of profit) suffered by the Client arising out of a breach by TCS of these terms and conditions.

11.2 In the event of any breach of this contract by TCS, the remedies of the Client shall be limited to damages which under no circumstances shall exceed the Price of the Services.

11.3 The Client shall not be entitled to set off against or deduct from the Price any sums owed or claimed to be owed to the Client by TCS.

11.4 Neither party shall be liable for any default due to any act of God, war, terrorism, strike, lock-out, industrial action, fire, flood, drought, storm or other event beyond the reasonable control of either party.

12. No Warranties

TCS provides Services "as is" and makes no representations or warranties of any kind related to the Services, except as expressly stated in these terms and conditions. TCS does not warrant that Services will be uninterrupted or error-free.

13. Indemnification

The Client hereby indemnifies TCS from and against any and all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to the Client's breach of any of the provisions of these Terms or any negligent or wrongful act of the Client.

14. Assignment and Variation

14.1 TCS may license or sub-contract all or any part of its rights and obligations without the Client's consent.

14.2 TCS reserves the right to review these terms and conditions at any time. Any changes will take effect from the date on which TCS notifies the Client of such change.

14.3 The Client is not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms without TCS's written consent.

15. Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

16. Governing Law

These Terms will be governed by and interpreted in accordance with the laws of Queensland, Australia, and the Client submits to the non-exclusive jurisdiction of the state and federal courts located in Queensland for the resolution of any disputes.
